Divorce, Custody, and Family Law

“Family Law” encompasses a wide range of cases including divorce (also known as “dissolution of marriage), custody, visitation, child support and some types of cases handled solely in Juvenile Court such as “Dependency, Neglect and Abuse” (also known as DNA cases). Although some “family law” cases can be handled relatively simply (especially in cases where both parties have reached an agreement as to their dispute), quite frequently these cases can become quite difficult. That’s why you need an attorney well versed and experienced in these areas.

I am conveniently located in Princeton, KY and have over 25 years experience handling all aspects of “family law” cases throughout western Kentucky. Call or email me today for your initial consultation.

DUIs and Criminal Defense

Crimes in Kentucky can generally be broken down into two categories: Felonies and Misdemeanors. Felonies are considered the more serious criminal offenses and are punishable by up to a year or more in the state penitentiary. Felonies are further divided into separate “classes” (Capital crimes, Class A, Class B, Class C and Class D. Class D is the lowest and least serious category but is punishable by 1-5 years plus fines). Examples of felonies include crimes like murder, rape, drug trafficking etc.

Misdemeanors are less serious crimes and the maximum punishment for a misdemeanor (Class A) is 12 months in county jail and/or a fine up to $500. For example, possession of a small amount of marijuana not intended for resale is generally a misdemeanor.

“Driving Under the Influence” (better known as DUI) is a different animal altogether and its penalties can include jail time, fines as well as loss of driving privileges for certain periods of time. DUI is a complex area of the law that needs an experienced attorney. Cases that seem hopeless can often be won in the hands of a skilled and experienced DUI attorney.

Auto Accidents and Personal Injury

In addition to motor vehicle accident cases, the Law Office of Barclay W. Banister handles other types of "personal injury" claims where an individual is injured due to the negligence of others. For example, our firm handles "slip & fall" cases where someone is injured due to dangerous or defective conditions existing on the property of another person or business.

We are certainly not limited in the types of injury cases that we will handle and if you believe you have a claim for damages due to personal injuries, you should call or email us for your case evaluation. These cases are all handled on a "contingent fee" basis, meaning we only get paid if you do. Our fee is a percentage (usually 1/3) of the amount that you receive and you will owe us nothing if we do not settle your case or prevail at trial.

If you or a loved one has suffered a personal injury due to someone else's negligence, do not hesitate to contact the Law Office of Barclay W. Banister today.
